TrustSafe LLC® Terms and Conditions: The following are the terms and conditions (the "Terms") for the use of the TrustSafe LLC® website (the "Site"), TrustSafe LLC® services, and related material. Generally with each visit to the Site you signify your agreement to these Terms. These Terms were last modified on October 1, 2024. TrustSafe LLC and its agents own the TrustSafe LLC® trade name, brand, trademark, and websites. TrustSafe LLC® material and services are defined as any intellectual property, materials, documents, web pages, software, products, web links, email, information, or any other materials provided by or previously provided by TrustSafe LLC® or the Site, including any portion thereof. TrustSafe LLC® materials and services are defined as anything you purchase from TrustSafe LLC®. If you do not wish to be bound by these Terms, then you are not granted authority to use or access this Site nor any TrustSafe LLC® material and/or service. Use of TrustSafe LLC® materials and services: Generally You agree not to use any TrustSafe LLC® Material and TrustSafe LLC® Services for any purpose which is against any law in your jurisdiction nor in any jurisdiction nor for any purpose which would not give full effect to the within Terms even if that purpose is otherwise allowed under the Terms. Document is defined as the ordered, purchased and/or supplied document or produce produced through the use of TrustSafe LLC’s® services. You are granted rights to the Document/Service when you pay for access to a product and/or service. Any paid Document/Service granted is subject to the within Terms and entitles you to: use the Document or product as specified by the within Terms only; make copies of the Document for your personal use; make necessary mechanical copies (e.g. printed or photocopied) of the Document for your personal records and as required for the specific transaction for which the Document(s) is/are intended. You may end a Service in the manner specified on the order page, your account area, or the help documentation. TrustSafe LLC® retains the right to cancel any sale or Site access at any time, in which case you will only be charged for the sale or Site access that was in effect. Your Right to any document/service is valid for the jurisdiction of the document that you select when you purchase your Document/Service. You will be charged in the currency of that country. If you are not a party in transactions in which a Final Document is used or if you obtained the Final Document under a free trial, you are not allowed to enter into new transactions using the Final Document starting one month after the expiry of the corresponding product access time period. To access products, you must provide credit card details to TrustSafe LLC® as required by the Site. TrustSafe LLC® will charge credit cards in accordance with displayed pricing in return for access to products and lawful services and if free trials are not canceled before the specified time period. Payments made to TrustSafe LLC® are processed by TrustSafe LLC. Subject to these Terms, if you are evaluating the Site strictly as a potential customer or to participate in our affiliate program, you are granted the right to evaluate the Site for that purpose only. Legal Advice, Information and Decision Making Responsibility TrustSafe LLC® is not a law firm and does not provide Legal Advice (as defined below). Your use of TrustSafe LLC® Material or any TrustSafe LLC® Services does not create a solicitor-client relationship between you and TrustSafe LLC® . You agree that all decisions you make on legal matters are your full responsibility and you agree to retain legal counsel licensed to practice in your jurisdiction regarding any legal issue of enough importance to reasonably require it. You agree that TrustSafe LLC® does not provide Legal Advice. If you receive any communication from TrustSafe LLC® , its agents, its employees or any other associated entity, you agree that it is NOT Legal Advice nor a communication that is authorized by TrustSafe LLC® and you agree to immediately delete and disregard it. Except as expressly provided in these Terms, you agree to accept full responsibility for determining the value of and for any use you make of TrustSafe LLC® Material or TrustSafe LLC® Services, and for obtaining any needed assistance from a properly licensed attorney to assess the value of and appropriate uses for any TrustSafe LLC® Material or TrustSafe LLC® Services. For the purposes of these Terms, Legal Advice is defined to include the following: any legal related communication, work or service which, under the governing law of your jurisdiction, is only allowed to be performed by or under the supervision of a properly licensed attorney; advice on which legal document or documents you have acquired, need or are best for your situation; determining the legal consequences that will or could result from how you acquired your document(s); whether you have included inappropriate, conflicting, or ambiguous information in or with the document(s) you received/purchased; whether you have omitted any necessary information, provisions or details from your document(s); and whether you require any additional documents or procedures. TrustSafe LLC® retains the right to make changes to its Affiliate Program(s) or other programs as it sees fit. Detailed Affiliate Program Terms and Conditions can be found within those Affiliate Program Terms and Conditions provisions and are not the responsibility of TrustSafe LLC®. Restrictions To the maximum extent allowable under applicable law: Except as explicitly identified in these terms, you agree not to publish, re-publish, lend, license, give away, look at the software, site nor data source code, modify said source code, post to an Internet web site, or use in an automated system any TrustSafe LLC® Material nor will you utilize TrustSafe LLC® Material in any way for the creation of an automated system or website, nor will you allow or assist a third party to do so. You agree to only use TrustSafe LLC® Material and TrustSafe LLC® Site as a customer. Documents and Services purchased are subject to these Terms, and are non-exclusive, non-transferable, and are revocable by TrustSafe LLC®. Any document purchased may be distributed on the internet without time limit by TrustSafe LLC® customers as part of a materially non-legal document package adding significant value. The rights granted under these Terms are granted to you as the customer only. If you are an organization, a purchase allows one individual within your organization to exercise the rights granted by these Terms. If multiple individuals within your organization require access, there must be a purchase for each individual. The appointed individual may not be changed. TrustSafe LLC® retains the right to prohibit organizations, groups, or individuals, or yourself from using its websites or TrustSafe LLC® Material or TrustSafe LLC® Services at its sole discretion. Assignment: This agreement cannot be assigned by customer(s) to any other party. Intellectual Property: All copyright, trade marks (including its distinguishing guise and/or trade dress), and other intellectual property rights (registered and unregistered) of TrustSafe LLC® Material belong to TrustSafe LLC® and its affilliates. TrustSafe LLC® reserves all of its rights in the TrustSafe LLC® Material and Services. Nothing in the within Terms grants you a right or licensee to use any intellectual property rights owned or controlled by TrustSafe LLC® or any other third party except as expressly provided in these Terms. In addition, TrustSafe LLC® Material and Services contains information and intellectual property that is selected and organized by TrustSafe LLC® and represents significant work and trademark secrets of TrustSafe LLC® only. Nothing in the within Terms should be construed as granting any license or right to use any TrustSafe LLC® material, service nor intellectual property displayed or used by TrustSafe LLC® except as expressly provided in the within Terms. By using the Site you agree to the following: All TrustSafe LLC® material and services are the property of TrustSafe LLC® and its affiliates; you will not use any TrustSafe LLC® material and services for any purpose other than is expressly permitted in these Terms; you will not distribute for profit and/or gain in/to any other medium any of TrustSafe LLC® material and services without TrustSafe LLC’s® prior written authorization or as expressly provided within these Terms; any distribution or past distribution of any TrustSafe LLC® material and services by you which violates these Terms are subject to damages against you in an amount equal to that which would be payable by a copyright infringer for knowingly copying or plagiarizing protected material, and based on each page of any website which uses TrustSafe LLC® material and services being a separate work under the Copyright Act and each access of a page of a website by a customer being a separate publication of a work. TrustSafe LLC® shall have the right to represent its affiliates in any dispute. Limited Warranties: Except as expressly provided in these Terms, to the maximum extent permitted under applicable law, TrustSafe LLC® material and services are provided "as is" without any kind of warranty. You accept full responsibility for determining whether TrustSafe LLC® material and services are suitable for any particular purpose and for protecting yourself against any and all possible consequential damages. TrustSafe LLC® does not authenticate users' signatures nor the validity of any document uploaded and stored in TrustSafe LLC’s® digital database. TrustSafe LLC® does not authenticate users’ identities when using the search, upload and order features. TrustSafe LLC® electronic functionality does not track IP addresses, nor include digital certificates, nor use a certification authority, nor any other third party verification. You accept full responsibility for determining whether an electronic document is suitable for any particular purpose. Except as expressly provided in these Terms or where prohibited by law, TrustSafe LLC® is not responsible for any loss, injury, claim, liability, damage, or consequential damage related to your use of TrustSafe LLC’s® site, material and/or services, nor for inaccessibility of TrustSafe LLC® material and services whether from errors or omissions in the content of TrustSafe LLC® material, services, digitally stored information and documents, nor any other linked sites, nor for any other reason. Use of TrustSafe LLC® material and services is at your own risk. TrustSafe LLC® does not represent or warrant that TrustSafe LLC® material, services, documents, information and the Site or any linked sites are free of any harmful materials. Maximum Liability: Except as expressly provided in these Terms or where prohibited by law, the maximum liability of TrustSafe LLC® is the amount paid to TrustSafe LLC® by the customer; however, where TrustSafe LLC® has provided a service, the maximum liability of TrustSafe LLC® for any services, document or material is equal only ton the portion of the amount paid to TrustSafe LLC® by the customer specifically for the payment made to TrustSafe LLC®. Guarantees and Refunds: All guarantees are subject to any limitations specified in any TrustSafe LLC® service. Guarantees are only available to customers who paid on the product before the guarantee is claimed and are not available on free promotions. For a guarantee to apply to a service it must be explicitly promoted as a TrustSafe LLC® service for the associated product at the time of payment. A customer is only entitled to one Guarantee claim relating to one Guarantee category of one product or service. Should a customer accept a Guarantee related payment from TrustSafe LLC® , then he/she/they waive any and all right to additional claims against TrustSafe LLC® regarding any Guarantee unless otherwise agreed to in writing. TrustSafe LLC® has no obligation to refund any one time purchases. The following additional restrictions apply to the Guarantee payments for mistakes: The mistake must be made by a TrustSafe LLC® employee and/or agent and shall not pertain to any document(s) and/or information uploaded, managed and/or stored by customers; Guarantees only apply to TrustSafe LLC® mistakes, not to customer mistakes; and TrustSafe LLC® is only required to pay a customer once for a mistake no matter how many mistakes that customer may bring to TrustSafe LLC’s® attention. Free Trial Refund Policy: A. The terms and conditions of any TrustSafe LLC® offer will govern any free trials. TrustSafe LLC® has no obligation to refund any free trial services/purchases even when properly converted to apaid product access. B. TrustSafe LLC® has no obligation to refund accounts and/or purchases which were utilized and/or accessed after customer payment. Any request for refund must be made within thirty (30) days of the date of initial purchase and as authorized by TrustSafe LLC®. C. Legal Guarantee: Subject to any limitations or maximums specified in any TrustSafe LLC® material and/or service, including the specific guarantee amount related to any damage a customer allegedly claims to suffer in a legal judgment as a result of a clear TrustSafe LLC® mistake, shall not exceed $1,000 USD only. D. Other Guarantees and Refunds: TrustSafe LLC’s® maximum liability for any guarantee(s) specified on the Site shall not exceed $100 USD. Other guarantees and refund commitments specified in TrustSafe LLC® material and services are subject to a maximum of the amount paid by the customer and are subject to a claim being submitted within 30 days of purchase. Client Privacy: You consent that TrustSafe LLC® may use your personal information according to its Privacy Policy found at the Privacy Policy section on the Site. Further, by using its Site you agree to and accept TrustSafe LLC’s® Electronic Records and Communication Disclosure and its Terms and Conditions, and you affirmatively consent to receive all information and disclosures from TrustSafe LLC® electronically unless agreed otherwise in writing by TrustSafe LLC®. Additionally, by using TrustSafe LLC’s electronic services you acknowledge and agree that all information and documents are digital and electronically stored as uploaded and managed by customers. In any case where you require to receive information and disclosures on paper instead of electronically, you agree that you shall print the electronic and/or digital documents, as this Site and TrustSafe LLC® provides all documents, information and disclosures only in electronic form. You can also print TrustSafe LLC’s® Site Terms of Use and Privacy Policy. If you want to receive paper records you should not use TrustSafe LLC’s® Site. You may withdraw your consent to receive information and disclosures electronically at any time. To do so, please delete your account through your “My Account” page on the Site. By withdrawing your consent, you will no longer be able to use the Site, nor any TrustSafe LLC® materials or services. You can update your contact and billing information through your “My Account” page on the Site. To access the Site and the TrustSafe LLC® materials and/or services you must have the following: (1) a computer or smartphone with enough memory to access, view, and store documents; (2) an internet connection; (3) an internet browser. If you want to view your documents in PDF (portable document format) you must also have a program with which to view PDFs. Terms and Headings: All of the within Terms herein are valid regardless of the heading. To the maximum extent allowable under the law, the within Terms take precedence over any conflicting TrustSafe LLC® material or service should it be judicially found that the conflicting TrustSafe LLC® material and or service is legally relevant to this Agreement under law. Indemnification: Except where prohibited by law, you agree to indemnify and hold TrustSafe LLC® , its directors, officers, members, agents and employees, harmless from any and all actions, claims, losses, damages, liabilities and expenses including legal fees, asserted by any third party due to or arising from your use of the Site or TrustSafe LLC® materials, services, information and/or ordered products/data. Governing Law: Except where prohibited by law, the within Terms are governed by the County of Washington, State of Utah, U.S. and except where prohibited by law, you irrevocably agree to the exclusive jurisdiction thereof regardless of your area of residence. By using this Site, all agreements entered into by customers and TrustSafe LLC® whether implied or direct are considered as having occurred within the jurisdiction of the County of Washington, State of Utah. Binding Arbitration: Subject to exceptions specified herein, if you and TrustSafe LLC® are unable to resolve any dispute by informal direct negotiations, then any resolution of such dispute shall be conducted exclusively by binding arbitration. A request for appointment of an arbitrator must be made in writing. Upon receipt of said written request, TrustSafe LLC® shall have 90 (ninety) days to choose and appoint an independent and impartial arbitrator. The arbitration will be held in the City of St George, County of Washington, State of Utah, U.S.. The cost of the binding arbitration proceedings and any proceeding in court to confirm or to vacate any arbitration award, including without limitation reasonable attorneys fees and costs, shall ill be borne by the non-prevailing party as determined and awarded by the arbitrator. Exceptions to the use of binding arbitration are as follows: TrustSafe LLC® may bring forth a lawsuit, without using binding arbitration, should the lawsuit involve intellectual property infringement or injunctive relief. Also, either party may use small claims court when limited damages are sought. Class Action Waiver: By using the Site you agree that you shall not seek to have any dispute heard as a class action, private attorney general action or in any other proceeding in which either party acts or proposes to act in a representative capacity. Arbitration or any other proceeding to resolve any dispute, in any forum, shall be conducted solely on an individual basis and not combined with another without the prior written consent of all parties to all affected arbitrations or proceedings. Modification of the Terms: TrustSafe LLC® may, in its sole discretion may increase prices and/or change these Terms at any time. Other terms and conditions are only valid when signed in writing by an authorized TrustSafe LLC® officer. Severability: If any term, covenant, condition or provision of these Terms is held by a court of competent jurisdiction to be invalid, void or unenforceable, such provision is to be excluded to the extent of such invalidity or unenforceability and all other provisions shall remain in full force and effect; and, to the extent permitted and possible, the invalid or unenforceable provision shall be deemed replaced by a provision that is valid and enforceable which most closely expresses the intention of any such invalid or unenforceable provision. Waivers: No failure or delay on the part of TrustSafe LLC® in exercising any right or power under these Terms shall serve to operate as a waiver of such right or power. Whole Agreement: Except as explicitly set forth herein, these Terms, the pricing displayed on the Site, the Site's Disclaimer, Privacy Policy, and, if you are an affiliate, the Affiliate Program Terms and Conditions, constitute the entire Agreement between you and TrustSafe LLC®, notwithstanding any of the following: TrustSafe LLC® materials and/or services other than this Agreement; communication between you and TrustSafe LLC® including telephone, email and online chat assistance, or announcements, newsletters or promotional materials from TrustSafe LLC®; Printed and/or saved document(s), Disclaimer, Privacy Policy and Editorial Policy.  TrustSafe LLC®is not a law firm and cannot provide legal advice. TrustSafe LLC® provides information and/or copies of digitally stored documents that were created, provided by, and uploaded by others.
